Three separate actions were commenced in the superior court of Dane county by the plaintiff, City of Madison, against defendant Chicago, Milwaukee, St. Paul and Pacific Railroad Company, on complaints alleging that the defendant violated the provisions of sec. 10.24 of the ordinances of the city of Madison by blocking for more than five minutes: Mills and Dayton Streets on July 19, 1954 (Case No. 64); Charter Street on June 3, 1953 (Case No. 65); and Mills and Dayton Streets on December 6, 1954 (Case No. 66). Convictions in all three cases were appealed by defendant to the circuit court of Dane County. Case No. 65 was the only case which was tried in the circuit court. Cases No. 64 and No. 66 were decided in accordance with the decision in Case No. 65. The appeals are from judgments of conviction in all three cases in circuit court.
